Section 40-23-190 Conditions for Remote Entity Nexus. (a) An out-of-state vendor has substantial
nexus with this state for the collection of both state and local use tax if: (1) The out-of-state
vendor and an in-state business maintaining one or more locations within this state are related
parties; and (2) The out-of-state vendor and the in-state business use an identical or substantially
similar name, tradename, trademark, or goodwill, to develop, promote, or maintain sales, or
the in-state business and the out-of-state vendor pay for each other's services in whole or
in part contingent upon the volume or value of sales, or the in-state business and the out-of-state
vendor share a common business plan or substantially coordinate their business plans, or the
in-state business provides services to, or that inure to the benefit of, the out-of-state

Section 40-7-26 Department of Revenue may act in advisory capacity; effect of approval of valuation
by department; nonapproved assessment docket. The Department of Revenue or the agents or assistants
thereof may work in an advisory capacity with the several county tax assessors of the state
in the assessment and valuation of property. Any valuation fixed by the tax assessor on any
property returned for taxation may be approved by the Department of Revenue, which approval,
if made, must be shown on each separate return so approved. When a tax return has been so
approved by the Department of Revenue, the state has no appeal from such approved assessment.
The taxpayer, however, may appeal from such assessment in the same manner and within the same
time as appeals are allowed from nonapproved assessments. The several county tax assessors

Section 40-18-74 Payment of amounts withheld. (a) Every employer required to deduct and withhold
tax under Section 40-18-71 shall for each quarterly period, on or before the last day of the
month following the close of each quarterly period, file a return and pay to the Department
of Revenue the tax required to be withheld under Section 40-18-71. Where the aggregate amount
required to be deducted and withheld by any employer for either the first or second month
of a calendar quarter exceeds $1,000 the employer shall by the fifteenth day of the succeeding

words shall have the following meanings: (1) DECLARATION OF RESIDENCE. Any written document
