Section 45-44-244.33 Filing of returns. When a monthly or quarterly return is not filed by
an employer and the fees are not paid, the employee for whom no return has been filed and
no payment has been made shall file a return with the revenue commissioner on or before the
first day of the second month following the end of each monthly or quarterly period, showing
in the return his or her gross receipts subject to fees for the month or quarter. He or she
shall also file a return with the revenue commissioner on or before January 31 of each year
in which his or her employer has failed to file any monthly or quarterly return required in
the preceding calendar year, showing on the return the gross receipts subject to fees during
the preceding calendar year. If, for any reason, all fees were not withheld by the employer
from the gross receipts, the employee shall file each return required on a form obtainable

Section 40-18-74 Payment of amounts withheld. (a) Every employer required to deduct and withhold
tax under Section 40-18-71 shall for each quarterly period, on or before the last day of the
month following the close of each quarterly period, file a return and pay to the Department
of Revenue the tax required to be withheld under Section 40-18-71. Where the aggregate amount
required to be deducted and withheld by any employer for either the first or second month
of a calendar quarter exceeds $1,000 the employer shall by the fifteenth day of the succeeding

Section 40-17-329 Exemptions. (a) Unless otherwise provided for in this subsection, sales of
motor fuel to the following are exempt from the tax levied by subsection (a) of Section 40-17-325
and shall not be paid at the rack: (1) All motor fuel exported from this state for which proof
of export is available in the form of a terminal issued destination state shipping document
that is a. exported by a supplier who is licensed in the destination state or b. is sold by
a supplier to a licensed exporter for immediate export to a state for which the applicable
destination state motor fuel excise tax has been collected by the supplier who is licensed
to remit the tax to the destination state. If the motor fuel is exempt from the excise tax
due to the product being exported from this state, then the motor fuel exported from this

deduct from each payment due each employee the amount of the fees due from each employee beginning
