Section 2-28-7 Denial or revocation of permits by commissioner and appeals therefrom. Upon
determination by the commissioner that any person certified or having a permit issued under
the provisions of this chapter or any person who has applied for such certification or a permit
has violated or failed to comply with any of the provisions or requirements of this chapter
or any rules and regulations promulgated thereunder, the commissioner shall be authorized
to revoke such certification or permit, or both, or he shall refuse to issue a certification
or a permit, or both, to an applicant therefor. The performance of unauthorized work not covered
by a permit, making misrepresentations or any fraudulent practices, failure to perform a contract,
failure to have in its employ, when required, a certified operator or branch supervisor or

Section 22-22-14 Criminal penalty for violation of chapter, etc. (a) Any person who willfully
or with gross negligence violates any provision of the chapter, or rule, regulation or standard
adopted under this chapter, or any condition or limitation in a permit issued under this chapter
shall be punished by a fine of not less than $2,500.00 nor more than $25,000.00 per day of
violation or by imprisonment for not more than one year, or by both. If the conviction is
for a violation committed after a first conviction of such person under this subsection, punishment
shall be by a fine of not less than $5,000.00 nor more than $50,000.00 per day of violation
or by imprisonment for not less than one year and one day nor more than two years, or by both.

qualify for participation in the voluntary cleanup program as provided in this chapter, an
applicant shall not, unless granted a variance under subsection (b), be in violation of any

Section 33-6-10 Enforcement of chapter, rules, etc.; prosecutions under chapter; violations
and penalties. (a) This chapter and rules and orders adopted under this chapter shall be enforced
by the State Board of Health and the State Department of Conservation and Natural Resources
according to rules adopted by the board and department. (b) Any person may complain under
oath to a magistrate, district attorney, or grand jury concerning a violation of this chapter
or of a rule adopted under this chapter and if a warrant is issued by the magistrate or district

Section 34-43-19 Construction with other regulations. (a) Except as otherwise provided in subsection
(b), this chapter shall supersede any regulation adopted by a political subdivision of the
state related to the licensing or regulation of massage therapists and massage therapy establishments.
(b) This section shall not affect: (1) Local regulations relating to zoning requirements or
occupational license taxes pertaining to massage therapists and massage therapy establishments.
(2) Local regulations that do not relate to the practice of massage therapy by qualified persons.

Section 22-30-19 Penalties and remedies. (a) Whenever, on the basis of any information, the
department determines that any person is in violation of any requirement of this chapter,
any rule or regulation promulgated by the department or any permit issued under authority
