Section 39-3-3 Penalties for violations of Section 39-3-2; reliance by employers upon certificates of sheriffs, etc., as to residence of workmen or laborers. (a) Whoever violates Section 39-3-2 is guilty of a misdemeanor and shall be fined not more than $100.00 or imprisoned for not more than 60 days or both, at the discretion of the court, and every day's employment of each workman or laborer in violation of Section 39-3-2 shall constitute a separate offense. (b) Where any workman or laborer furnishes his employer with a certificate of the sheriff, register of the circuit court or registrar of the county of his domicile to the effect that such workman or laborer has actually resided in this state two years next preceding such employment, such employer, acting in good faith, shall be relieved of any liability by reason of employing such person.
