Section 15-12-25 Reimbursement of fees of court appointed counsel by defendant; default. (a)(1) A court may require a convicted defendant to pay the fees of court appointed counsel. Fees of court appointed counsel for the purposes of this section, shall mean any attorney's fees and expenses paid an appointed counsel, contract counsel, or public defender. (2) The court shall not order a defendant to pay the fees of court appointed counsel unless the defendant is or will be able to pay them. In determining the amount and method of payment of these fees, the court shall take into account the financial resources of the defendant and the nature of the burden that payment of the fees will impose. Section 45-48-80 Additional court costs - Child protection. (a) In order to further provide for the protection and welfare of children in Marshall County who are alleged to be or have been found by the juvenile court of the county to be abused and neglected or otherwise dependent pursuant to Section 12-15-102, a fee of four dollars ($4) shall be charged and collected by the clerk of the court on each district court case in Marshall County. The fee shall be in addition to all other costs and charges in district court cases in Marshall County. (a) A violation of any court order issued pursuant to this division is punishable as a contempt of court by a fine of not less than five hundred dollars ($500) nor more than thirty thousand dollars ($30,000), or by imprisonment for not more than one year, or both. At least one-half of all fines collected as punishment for contempt shall be paid into the general fund of the county if the action against the defendant was commenced by the county governing body or a county government agency.
