Section 26-10D-3 Definitions. For the purposes of this chapter, the following terms
shall have the following meanings: (1) ADVERSE ACTION. With respect to a child placing agency,
any action that materially alters the license under a state program, including any of the
following: a. Taking an enforcement action against the entity. b. Refusing to issue a license.
c. Refusing to renew a license. d. Revoking a license. e. Suspending a license (2) CHILD PLACING
AGENCY. A private child-care facility which receives no federal or state funds and which receives,

Section 26-23E-10 Paternity inquiries of pregnant minor child; reporting requirements.
(a) Any minor child under the age of 16 seeking an abortion from an abortion or reproductive
health care facility shall be asked by the physician performing the abortion or his or her
agent to state the name and age of the individual who is believed to be the father of the
unborn child. While the minor child may refuse to provide the father's name and age, she should
be encouraged to do so by the physician or agent consistent with the physician's legal obligation
to reduce the incidence of child abuse when there is reason to suspect that it has occurred.
(b) In addition to any other abuse reporting requirements that may apply to the staff of an
abortion or reproductive health center, if the reported age of the father is two or more years

Any person who comes under investigation by the Department of Human Resources for the abuse
or neglect of a child or children and who is employed by, serves as a volunteer for, holds
a license or certificate for, or is connected with any facility, agency, or home which cares
for and controls any children and which is licensed, approved, or certified by the state,
operated as a state facility, or any public, private, or religious facility or agency that
may be exempt from licensing procedures shall be granted the following due process rights
by the Department of Human Resources: (1) The department shall notify the alleged perpetrator
that an investigation has commenced against him or her after such investigation has officially
