Section 22-50-11 Department - Additional and cumulative powers. The Department of Mental Health
is given hereby the following additional and cumulative powers through its commissioner: (1)
It is authorized and directed to set up state plans for the purpose of controlling and treating
any and all forms of mental and emotional illness and any and all forms of mental retardation
and shall divide the state into regions, districts, areas or zones, which need not be geographic
areas, but shall be areas for the purpose of establishing priorities and programs and for
organizational and administrative purposes in accordance with these state plans. (2) It is
designated and authorized to supervise, coordinate, and establish standards for all operations
and activities of the state related to mental health and the providing of mental health services;

Section 18-1B-1 Statement of legislative intent. In light of the decision and certain opinions
recently announced by the United States Supreme Court interpreting the extent of the power
of government to take property for public use as described in the Fifth Amendment to the United
States Constitution and providing that individual states may restrict the exercise of that
power, the Legislature intends in enacting this chapter and amending Sections 11-47-170 and
11-80-1, to ensure that governmental bodies in Alabama vested with all or any part of the

Section 18-4-14 Procedure for acquiring real property. Whenever real property is acquired by
a state agency in connection with any programs or projects, the acquisition shall be conducted,
to the greatest extent practicable, in accordance with the following: (1) An agency shall
make every reasonable effort to acquire, expeditiously, real property by negotiation. (2)
