Section 34-40-9 Professions and occupations not affected; chapter not applicable to certain persons. (a) Nothing in this chapter shall be construed as preventing or restricting any of the following persons from engaging in the profession or occupation for which they are licensed, certified, or registered in Alabama as follows: (1) Physicians and surgeons licensed by the Medical Licensure Commission of Alabama. (2) Dentists licensed by the State Board of Dental Examiners. (3) Optometrists licensed by the State Board of Optometry. (4) Nurses licensed by the Alabama Board of Nursing. In availing itself of the powers conferred by this chapter, the county commission shall provide for the appointment of a board of adjustment and may provide that the said board of adjustment shall, in appropriate cases and subject to appropriate conditions and safeguards, make special exceptions to the terms of the zoning ordinance or regulations in harmony with its general purposes and interests and in accordance with general or specific rules adopted pursuant to this chapter. Section 22-28-12 Motor vehicle emissions. (a) As the state of knowledge and technology relating to the control of emissions from motor vehicles may permit or make appropriate, and in furtherance of the purposes of this chapter, the commission may provide by rules and regulations for the control of emissions from any class or classes of motor vehicles.
