Section 45-37A-51.11 Death benefit for spouses and children not receiving certain benefits. (a) The words, terms, and phrases used in this section shall have the meaning ascribed to them by Act 929, or Section 45-37A-51.07, unless it appears from the context that a different meaning is intended. (b)(1) This section shall not apply to any firefighter or police officer, or to his or her spouse, child, or children, unless at the time of his or her death he or she had accumulated at least five years' credited service under Act 929. Section 25-5-69 Compensation to cease upon death or marriage of dependent; proportional benefits for dependents. (a) If compensation is being paid under this article to any dependent, the compensation shall cease upon the death or marriage of the dependent. Where compensation is being paid under this chapter to any dependent, in no event shall such dependent receive more than the proportion which the amount received of the deceased employee's income during his or her life bears to the compensation provided under this article. Section 25-5-66 Disposition of compensation upon remarriage of widow of employee who has another dependent. (a) In the event of the death of a married employee and if at the time of such death the employee (1) is in the active employment of the city, or (2) is receiving a pension either for disability or for longevity from the city a pension shall be paid to his or her spouse.
