Section 36-30-3 Payment of compensation - Generally. The compensation payable to surviving beneficiaries or dependents of peace officers, firefighters, or rescue squad members who are killed under the circumstances prescribed in Section 36-30-2 shall be paid to the beneficiaries designated by those peace officers, firefighters, or rescue squad members. If no beneficiaries have been designated, or if none remain, the compensation shall be paid to the persons entitled thereto without administration or to a guardian or such other person as the awarding authority may direct for the use of the persons entitled thereto, as follows: (1) If the deceased peace officer, firefighter, or rescue squad member leaves a dependent spouse and no other dependents or partial dependents, the total amount of the compensation provided for in Section 36-30-2 shall be paid to the surviving spouse. Section 36-30-41 Applicability; compensation for qualified firefighters; burden of proof. (a) This article shall apply to firefighters who, upon entering the service of the state as firefighters, have successfully passed a physical examination which failed to reveal any evidence of a firefighter's occupational disease and who have completed at least three years' service as firefighters. If a physical examination was not required at the time of entry into service, a firefighter who completes an exam by January 1, 2013, shall be deemed eligible for benefits under this section. Section 25-5-4 Reports and records of injuries for which compensation claimed. An employer shall keep a record of all injuries, fatal or otherwise, received by his or her employees arising out of and in the course of their employment and for which compensation is claimed or paid.
