Section 36-27-72 Disqualification of credit. Anything in this division to the contrary
notwithstanding, a member of the Employees' Retirement System shall not receive credit for
such service where at the time of retirement he has credit or is entitled to any benefits
whatsoever for the same service under any other retirement or pension plan which is wholly
or partly funded from public funds; provided that nothing herein shall be construed to apply
to participation in the federal Social Security program. In the event of disqualification

Section 16-25-11.4 Purchase of credit for prior service rendered as full-time employee
in office of clerk of circuit court or with Alabama State Employees Association. (a) Any acting
and contributing member of the Teachers' Retirement System of Alabama may elect to purchase
credit for prior service rendered as a full-time employee in the office of a clerk of the
circuit court in the State of Alabama or as a full-time employee with the Alabama State Employees
Association provided the member complies with the following conditions prescribed in this

system. Any active and contributing member of a city retirement system that participates in
the Employees' Retirement System under Section 36-27-6 who rendered prior service to
a non-participating employer funded by a city and a county which was eligible for participation
