Section 16-25-10.5 Executive officers and employees of Alabama Opportunities Industrialization
Center; contributions; creditable service. (a) The governing board of the Alabama Opportunities
Industrialization Center may, by resolution legally adopted to conform to the rules prescribed
by the Board of Control of the Teachers' Retirement System, elect to have its executive officers
and employees, from whatever source and in whatever manner paid, become eligible to participate
in the Teachers' Retirement System of Alabama, subject to all rules, regulations and conditions
thereof. (b) The governing body of the Alabama Opportunities Industrialization Center, having
made an election through a resolution as provided in subsection (a), its employees and executive

Section 36-27-6.5 Employers authorized to provide Tier I retirement benefits to Tier
II plan members. (a) Any employer participating in the Employees' Retirement System of Alabama
pursuant to Section 36-27-6, may, by adoption of a resolution by May 8, 2021, elect
to provide to its Tier II plan members the same retirement benefits provided to Tier I plan
members. Provided, however, the Employees' Retirement System Board of Control, based on a
staff review of the historical compliance with ERS requirements as well as the financial stability
of the local government entity, may elect to deny the election authorized herein. The local
entity may petition the Board of Control for a reconsideration of its action by May 8, 2021.

Section 36-27-170 Participation in plan. (a) As governed by this subsection, there exists
as a part of this retirement system, an optional account known as the Deferred Retirement
Option Plan, which may be cited as "DROP." The purpose of DROP is to allow, contractually,
in lieu of immediate withdrawal from service and receipt of a retirement allowance, continued
employment for a specific period of time, coupled with the deferral of receipt of a retirement
allowance until the end of such period of participation, at which time the member shall withdraw
