Section 35-11-290 Lien declared. Every owner of a cotton gin, peanut machine, or picker, or hay baling machine or press, or plant for drying or processing planting seeds, shall have a lien on the commodity processed thereby for the toll or charge of such processing, under any contract with the owner of the commodity, whether the toll or charge for such processing be expressed or implied. Such liens shall have priority over all other liens, mortgages, or encumbrances, whether existing or not at the time of the commencement of such processing or work, except the lien of a landlord as provided for in Section 35-9-30. The processor shall have the right to hold the processed commodity until the full amount of the toll or charge has been paid; and should the commodity be removed without knowledge and consent of the processor, the lien herein declared shall follow the commodity. Section 35-12A-11 Disposition of proceeds of sale. (a) The manufactured dwelling community owner may deduct from the proceeds of the sale any of the following: (1) The reasonable or actual cost of notice, storage, and sale as provided in this chapter. (2) Unpaid rental fees, but only to the extent that the manufactured dwelling community owner's lien has priority over the lien of any applicable lienholder. (3) Reasonable attorneys' fees and costs. Section 11-99A-31 Recordation of notice of lien. (a) All preliminary and final assessments shall constitute liens upon the property assessed. The council shall provide a copy of the preliminary and final assessment to the municipal or town clerk of the appointing government, either of which shall constitute notice to all of the existence of the preliminary or final assessment and their priority, the same as though recorded in the records of the office of the judge of probate, and all purchasers of property, whether bona fide purchasers or not, shall take subject to the assessment, whether or not having actual knowledge of the assessment.
