Section 10A-2A-1.20 Requirements for filing instruments; extrinsic facts. (a) Whenever
any filing instrument is to be filed with the Secretary of State or in accordance with this
chapter, such instrument shall be executed as follows: (1) Except as provided in subsection
(a)(3), the certificate of incorporation, and any other instrument to be filed before the
election of the initial board of directors if the initial directors were not named in the
certificate of incorporation, shall be signed by the incorporator or incorporators or the
successors and assigns of the incorporator or incorporators. If any incorporator is not available
then any other instrument may be signed, with the same effect as if the incorporator had signed
it, by any person for whom or on whose behalf the incorporator, in executing the certificate
of incorporation, was acting directly or indirectly as employee or agent, provided that the

Section 15-13-206 Alabama Professional Bail Bonding Board - Alabama Bail Bond Board
Fund. (a) There is created in the State Treasury for the use of the Alabama Professional Bail
Bonding Board a fund to be known as the Alabama Bail Bond Board Fund. (b) All application
and license fees, penalties, fines, and any other fees or funds collected by the board under
this article are to be deposited in this fund and used only to carry out the operations of
the board. (c) For the purpose of carrying out the objectives of this article and for the

promulgation and distribution of discipline policy; liability limited for discipline actions;
local boards may adopt more stringent guidelines. (a) The Legislature finds a compelling public
interest in ensuring that schools are made safe and drug-free for all students and school
employees. The Legislature finds the need for a comprehensive safe school and drug-free school
policy to be adopted by the State Board of Education. This policy should establish minimum
standards for classes of offenses and prescribe uniform minimum procedures and penalties for

Section 34-36-6 Powers and duties of board. (a) By rule, the board shall make provisions
to do all of the following: (1) Prepare or approve all examinations of applicants for licenses

(a) There is created an Alabama Board of Examiners in Counseling, to consist of seven members
who shall be citizens of this state and appointed by the Governor pursuant to the requirements

Section 5-19A-17 Penalties for willful violation of chapter or for false entry in required
records; compliance enforced by supervisor; order requiring person to refrain from violation.
(a) In addition to any other penalty which may be applicable, any licensee who willfully violates
this chapter or who willfully makes a false entry in any record specifically required by this
chapter shall be guilty of a misdemeanor and, upon conviction thereof, shall be punished by
a fine not in excess of $1,000.00 per violation or false entry. (b) Compliance with this chapter
shall be enforced by the supervisor who may exercise any authority conferred by law. (c) When
the supervisor has reasonable cause to believe that a person is violating this chapter, the
supervisor, in addition to and without prejudice to the authority provided elsewhere in this
chapter, may enter an order requiring the person to stop or to refrain from the violation.

person, corporation, or other legal entity who engages in any act or practice that violates
this article is liable for a civil penalty of up to fifty thousand dollars ($50,000) for each
violation. (b) Any person, corporation, or other legal entity who violates the terms of an
injunction or order issued under this article shall forfeit and pay a civil penalty of not
more than seventy-five thousand dollars ($75,000) per violation and shall be adjudged in contempt.
For the purpose of this section, any court issuing an injunction or order under this
article shall retain jurisdiction, and in such cases the Attorney General may petition for
recovery of civil penalties. (c) Upon a second or continuing violation of an injunction after
