Section 27-54A-2 Treatment under certain policies and contracts. (a) As used in this
section, the following words have the following meanings: (1) APPLIED BEHAVIOR ANALYSIS.
The design, implementation, and evaluation of environmental modifications, using behavioral
stimuli and consequences, to produce socially significant improvement in human behavior, including
the use of direct observation, measurement, and functional analysis of the relationship between
environment and behavior. (2) AUTISM SPECTRUM DISORDER. Any of the pervasive developmental
disorders or autism spectrum disorders as defined by the most recent edition of the Diagnostic
and Statistical Manual of Mental Disorders (DSM) or the edition that was in effect at the
time of diagnosis. (3) BEHAVIORAL HEALTH TREATMENT. Counseling and treatment programs, including

Section 27-21A-23 Statutory construction and relationship to other laws. (a) Except
as otherwise provided in this chapter, provisions of the insurance law and provisions of health
care service plan laws shall not be applicable to any health maintenance organization granted
a certificate of authority under this chapter. This provision shall not apply to an insurer
or health care service plan licensed and regulated pursuant to the insurance law or the health
care service plan laws of this state except with respect to its health maintenance organization
activities authorized and regulated pursuant to this chapter. (b) Solicitation of enrollees
by a health maintenance organization granted a certificate of authority shall not be construed
to violate any provision of law relating to solicitation or advertising by health professionals.
(c) Any health maintenance organization authorized under this chapter shall not be deemed

Section 34-27B-5 State Board of Respiratory Therapy - Created; composition; liability
of members; terms; meetings; expense reimbursement and per diem allowance. (a) The Alabama
State Board of Respiratory Therapy is created to implement and administer this chapter and
shall be composed of five members appointed by the Governor. Three of the members shall be
respiratory therapists, one member shall be the chief executive officer of a hospital, and
one member shall be a physician. The respiratory therapist members of the board appointed
by the Governor shall be selected from a list of names submitted by the Alabama Society for
Respiratory Care. The list shall include two names for each appointed position to be filled.
The respiratory therapist members appointed to the board shall be registered or certified
by the National Board for Respiratory Care or its successor organization. Respiratory therapists

Section 34-8A-3 Construction and application of chapter. (a) Nothing in this chapter

Section 34-23-181 Definitions. The following words shall have the following meanings
as used in this article: (1) HEALTH BENEFIT PLAN. Any individual or group plan, employee welfare
benefit plan, policy, or contract for health care services issued, delivered, issued for delivery,
or renewed in this state by a health care insurer, health maintenance organization, accident
and sickness insurer, fraternal benefit society, nonprofit hospital service corporation, nonprofit
medical service corporation, health care service plan, or any other person, firm, corporation,
joint venture, or other similar business entity that pays for insureds or beneficiaries in

Section 27-21A-1 Definitions. As used in this chapter, the following terms shall have
the following meanings, respectively: (1) AGENT. A person who is appointed or employed by
a health maintenance organization and who engages in solicitation of membership in such organization.

maintenance organization include, but are not limited to the following: (1) The purchase,

Section 22-8A-3 Definitions. As used in this chapter, the following terms shall have
the following meanings, respectively, unless the context clearly indicates otherwise: (1)

Section 27-7-1 Definitions. For the purposes of this chapter, the following terms shall
have the meanings respectively ascribed to them by this section: (1) BUSINESS ENTITY.
