Section 34-27-59 Acts constituting violation of article - Failure to disclose total financial
obligation, etc., in contract. It shall be a violation of this section for any seller of vacation
time-sharing plans to fail to fully disclose in the contract in boldface type of a size no
smaller than any other type used in the body of the contract to purchaser: (1) The total financial
obligation of the purchaser, which shall include the initial purchase price and any additional
charges to which the purchaser may be subject. (2) Any individual or business entity which
has or may have the right to alter, amend, or add to charges to which the purchaser may be
subject and the terms and conditions under which such charges may be imposed. (3) The nature
and duration of each agreement between the business offering the vacation time-sharing plans
for sale and the individual or business entity managing the accommodations or other facilities.

Beginning with the fiscal year commencing on October 1, 1987, the first nine million five

(a) For purposes of this section, the following words shall have the following meanings: (1)
ADVERTISEMENT. Information communicated in a manner designed to attract public attention to
a referral service, participating dentist, or a practice of dentistry. (2) DENTAL REFERRAL
SERVICE. A person, firm, partnership, association, corporation, agent, or employee of any
of the foregoing that engages in any business or service for profit that in whole or in part
includes the referral or recommendation of persons to a dentist for any form of dental care
or treatment. (3) DENTIST. Any person licensed to practice dentistry or any entity authorized
by law which is formed for the purpose of practicing dentistry. (4) FALSE, FRAUDULENT, MISLEADING,
OR DECEPTIVE STATEMENT. A statement or claim having one or more of the following characteristics:

Section 34-27-36 Disciplinary action - Generally. (a) The commission or its staff may on its
own, or on the verified complaint in writing of any person, investigate the actions and records
of a licensee. The commission may issue subpoenas and compel the testimony of witnesses and
the production of records and documents during an investigation. If probable cause is found,
a formal complaint shall be filed and the commission shall hold a hearing on the formal complaint.
The commission shall revoke or suspend the license or impose a fine of not less than one hundred
dollars ($100) nor more than two thousand five hundred dollars ($2,500), or both, or reprimand
the licensee in each instance in which the licensee is found guilty of any of the following
