Section 33-5A-2 Removal. (a) A law enforcement officer may request a service to remove a vessel from public property under any of the following circumstances: (1) The vessel is determined by the officer to be abandoned. (2) The vessel is left unattended because the operator of the vessel has been arrested. (3) The vessel is determined by the officer to pose a threat to public health or safety. (4) The vessel is determined by the officer to be a derelict vessel. (b) An owner of private property may request a service to remove an abandoned or derelict vessel from the private property to a storage place. (c)(1) A law enforcement officer who directs the removal of a vessel in accordance with this chapter shall be liable only in accordance with Section 36-1-12. Section 33-5A-11 Refusal or failure to remove derelict vessel. (a) It is unlawful for a person who is the owner of a derelict vessel to refuse or fail to remove the derelict vessel from the waters of this state within 24 hours after a verbal or written request from a law enforcement officer. (b)(1) A violation of this section is a Class A misdemeanor if the vessel is a Class 4 vessel as described in Section 33-5-17. (2) A violation of this section is a Class B misdemeanor if the vessel is a Class 3 vessel as described in Section 33-5-17. Section 45-43-170.04 Solid waste disposal - Fees; public nuisances. (a) The Lowndes County Commission shall by resolution provide for the orderly collection of fees charged under this article. The county commission may establish a periodic payment system and is authorized to purchase necessary supplies and materials and employ personnel necessary to effectuate any such periodic payment system.
