Section 41-10-141 Powers and duties of authority generally. An authority shall have the following
powers, together with all powers incidental thereto or necessary to the discharge thereof
in corporate form: (1) To have succession by its corporate name for the duration of time (which
may be in perpetuity) specified in its certificate of incorporation; (2) To maintain civil
actions and have civil actions maintained against it in its corporate name, except as otherwise
provided in this article, and to defend civil actions against it; (3) To adopt and make use
of a corporate seal and to alter the same at pleasure; (4) To amend its certificate of incorporation
by filing in the office of the Secretary of State a certificate signed by all of the directors

Section 45-8-90 Economic Development Council - Creation; composition; powers and duties. (a)(1)
For the purposes of promoting industry and trade and economic development and to assist Calhoun
County and the municipalities located therein in their pursuits therefor and to provide for
the exercise by the county and the municipalities of certain powers and authority proposed

Section 11-50-2 Acquisition of power lines and rights-of-way, etc., incident thereto. (a) Cities
and towns in this state are authorized to construct, lease, purchase, or otherwise acquire
power lines for the transmission of electricity from any point in this state or any other
state to said city or town for the purpose of serving the needs of its citizens. (b) For the
purposes of this section cities and towns may exercise the right of eminent domain in acquiring
title to land for rights-of-way, power stations, and other purposes necessary to the operation

Section 23-1-45 Acquisition of rights-of-way. Any other provision of law to the contrary notwithstanding,
the Director of Transportation shall have authority to acquire the rights-of-way deemed necessary
by the State Department of Transportation for the construction of a state road, either by
purchase or by the exercise of the right of eminent domain in condemnation proceedings as
provided under the laws of this state, or the county or municipality in which such road deemed
necessary by the Director of Transportation is located shall acquire such rights-of-way deemed
necessary by the Director of Transportation, when requested to do so by said Director of Transportation.
Should the county or municipality fail or refuse to acquire said rights-of-way, the Director
of Transportation shall have authority to acquire such rights-of-way as first above authorized.
