Section 12-11A-3 Registration; petition for appointment. (a) A former judge qualified under this chapter who wishes to serve as a private judge must register with the Director of the Alabama Center for Alternative Dispute Resolution. The director shall verify that the former judge is qualified to serve as a private judge and shall compile and periodically update a list of registered private judges. (a) A sex offender required to register under this chapter may petition the court for relief from the residency restriction pursuant to subsection (a) of Section 15-20A-11 during the time a sex offender is terminally ill or permanently immobile, or the sex offender has a debilitating medical condition requiring substantial care or supervision or requires placement in a residential health care facility. The Twenty-third Judicial Circuit has the highest caseload in Alabama. The number of criminal cases has doubled during the last five years, resulting in a backlog of almost 4,500 cases, including approximately 18 capital murder cases. Some defendants have been awaiting trial for almost five years. The caseload facing prosecutors is staggering.
