Section 38-15-3 Definitions. For the purposes of this chapter, the following terms shall have the following meanings: (1) CHILD. A person under the age of 18 years. (2) COMMUNITY TREATMENT FACILITY FOR YOUTHS. A religious, faith-based, or church nonprofit, other nonprofit, or for profit youth residential facility that provides mental health treatment services to children in a group setting and that has the capacity to provide secure containment. (3) DEPARTMENT. The State Department of Human Resources. (4) DIRECTOR. The Director of the State Department of Human Resources. (5) LONG TERM YOUTH RESIDENTIAL FACILITY. Section 38-9F-5 Relief; remedies; full faith and credit. (a) The plaintiff's right to relief under this chapter shall not be affected by his or her leaving the residence or household to avoid further abuse. (b) The remedies and procedures provided in this chapter are in addition to and not in lieu of any other judicial protection actions that may be initiated by the victim in any other forum. (c) Any elder abuse protection order issued in this state shall be effective and enforceable in every county and jurisdiction in this state. Section 12-15-141 Emergency ex parte orders authorized upon showing of verified evidence of abuse or neglect; evidence required; hearing required within 72 hours of issuance of order. The juvenile court may enter an ex parte order of protection or restraint on an emergency basis, without prior notice and a hearing, upon a showing of verified written or verbal evidence of abuse or neglect injurious to the health or safety of a child subject to a juvenile court proceeding and the likelihood that the abuse or neglect will continue unless the order is issued. Section 12-15-312 Reasonable efforts in judicial determinations; situations in which reasonable efforts are not required to be made. Section 38-9-6 Protective placement or other protective services. (a) An interested person may petition the court to order protective placement or other protective services for an adult in need of protective services. No protective placement or other protective services may be ordered unless there is a determination by the court that the person is unable to provide for his or her own protection from abuse, neglect, exploitation, sexual abuse, or emotional abuse.
