Section 45-8A-120 Regulation of sale and consumption of alcoholic beverages. (a) This section only applies in the City of Piedmont in Calhoun County and in the police jurisdiction of the city. (b) Alcoholic beverages may be sold each day of the week for on-premises and off-premises consumption by licensed clubs and retail licensees of the Alcoholic Beverage Control Board in the City of Piedmont and in the police jurisdiction of the city. (c) The City Council of the City of Piedmont, by resolution or ordinance passed by a simple majority, may regulate, but may not prohibit, the sale of alcoholic beverages for both on-premises and off-premises consumption each day of the week by licensed clubs and retail licensees of the Alcoholic Beverage Control Board to the general public. Section 28-3A-20.1 Removal of resealed bottle of wine from premises of licensee. Notwithstanding any provision of this chapter to the contrary, a person holding a license to sell alcoholic beverages for consumption on the licensed premises may permit a customer to remove one unsealed bottle of wine for consumption off the premises if the customer has purchased and consumed a portion of the bottle of wine on the licensed premises. The licensee or the licensee's agent shall either: (1) recork the bottle of wine with the original or similar type cork that is reinserted in the bottle and the cork can only be removed by a corkscrew or similar device; or (2) securely reseal the bottle in a bag designed so that it is visibly apparent that the resealed bottle of wine has not been tampered with and shall provide a dated receipt for the resealed bottle of wine to the customer. Section 45-17-20.40 Authorization; referendum. (a) This section only applies to Colbert County. (b) The sale of alcoholic beverages during certain hours after 12:00 p.m. on Sundays is authorized within the county. The county commission may, by resolution, and the governing body of any municipality located within the county may, by ordinance, regulate and permit the sale of alcoholic beverages after 12:00 p.m. on Sunday by properly licensed retail licensees of the Alcoholic Beverage Control Board.
