Section 45-20-242.51 Privilege license and excise taxes. (a) The special county taxes levied
pursuant to this subpart shall be privilege license and excise taxes in substance as follows:
(1) Upon every person, firm, or corporation (not including the State of Alabama or the Alabama
Alcoholic Beverage Control Board or ABC stores) engaged or continuing within the county in
the business of selling at retail any tangible personal property whatsoever, including merchandise
and commodities of every kind and character (not including, however, bonds or other evidence

Section 45-37-20 Issuance and regulation of liquor licenses. (a)(1) As used in this section,
the following words and terms have the meanings hereby ascribed to them: a. ABC LAW. Chapter
3 of Title 28, which establishes and governs the Alcoholic Beverage Control Board. b. AUTHORITY.
A civic center authority heretofore or hereafter established by and under Acts 1965, No. 547,

Section 45-8-21.01 Issuance of license; review. (a) All other provisions of law, rules, or
regulations to the contrary notwithstanding, the Alabama Alcoholic Beverage Control Board
shall absolutely have no authority to issue any form of on-premise license in any municipality
in Calhoun County, Alabama, for the retail sale of any form of intoxicating beverages, including,
but not limited to, beer and other forms of malt beverages, wine, liquor, or other alcoholic
beverages regulated by the board, unless the application therefor has first been approved
by the governing body of the county or the municipality within whose corporate limits the
site of the license is to be situated. The county or the municipality shall adopt and promulgate
rules and regulations for the administration and processing of applications for such licenses.

Section 45-8A-25 Sale of alcoholic beverages. (a) This section only applies to the City of
Anniston and provides for the Anniston Ecotourism Beverage Bill. (b) Alcoholic beverages may
be sold each day of the week for on-premises consumption by licensed clubs and retail licensees

Section 28-3-53.2 "Board" and "mark up" defined; disposition of funds;
mark up increases. (a) The word board, wherever used in this section, shall mean the Alabama
Alcoholic Beverage Control Board provided for in Chapter 3, Title 28. The term mark up, wherever
used in this section shall mean the percentage amount added to cost plus freight on spirituous
or vinous liquors sold by the board, exclusive of taxes heretofore levied with respect thereto.
