Section 28-1-4 Delivery of alcoholic beverages to persons, corporations, etc., within
state by out-of-state manufacturers, suppliers, etc. (a) The words and phrases used in this
section shall have the meanings ascribed to them in Section 28-3-1 and any acts
amendatory thereof, supplementary thereto or substituted therefor. (b) It shall be unlawful
for common or permit carriers, operators of trucks, buses or other conveyances or out-of-state
manufacturers or suppliers to make delivery of any alcoholic beverage from without the State
of Alabama to any person, association or corporation within the state, except to the Alabama
Alcoholic Beverage Control Board and to manufacturers, importers, wholesalers and warehouses
licensed by the Alabama Alcoholic Beverage Control Board to receive the alcoholic beverages
so delivered. (c) Any violation of subsection (a) of this section shall be a misdemeanor,
punishable as provided in paragraph (1) of subsection (b) of Section 28-3A-25. (d)

Section 45-8-22 Special licenses; additional taxes; maintenance of records. (a) It shall
be unlawful for any person, firm, or corporation, other than the state Alcoholic Beverage
Control Board, to sell at retail in Calhoun County any spirituous or vinous liquors without
first obtaining a special license from the judge of probate that shall be in addition to all
other licenses required by law. The amount of the special license shall be determined by the
county commission and shall be levied in the same manner as other county licenses are levied.
Licenses required by this subsection shall expire on September 30th following the date of
purchase. All proceeds from sales of the special licenses shall be placed in the general fund

Section 28-3-184 Tax levied; collection; disposition of funds. (a) Levy. In addition
to the licenses provided for by Chapter 3A of this title, there is hereby levied a privilege
or excise tax on every person licensed under the provisions of said Chapter 3A who sells,
stores or receives for the purpose of distribution, to any person, firm, corporation, club
or association within the State of Alabama any malt or brewed beverages. The tax levied hereby
shall be measured by and graduated in accordance with the volume of sales by such person of
malt or brewed beverages, and shall be an amount equal to $.05 for each 12 fluid ounces or

(a) The Legislature finds that nudity, sexual conduct, and the depiction or simulation thereof
in conjunction with the furnishing of alcoholic beverages in public places is contrary to

Section 28-3-11 Invoices and receipts to be maintained by persons, firms, etc., selling
