Section 38-15-3 Definitions. For the purposes of this chapter, the following terms shall have the following meanings: (1) CHILD. A person under the age of 18 years. (2) COMMUNITY TREATMENT FACILITY FOR YOUTHS. A religious, faith-based, or church nonprofit, other nonprofit, or for profit youth residential facility that provides mental health treatment services to children in a group setting and that has the capacity to provide secure containment. (3) DEPARTMENT. The State Department of Human Resources. (4) DIRECTOR. The Director of the State Department of Human Resources. (5) LONG TERM YOUTH RESIDENTIAL FACILITY. Section 6-5-332.5 Persons who rescue child or incapacitated person from unattended motor vehicle; public safety officials. (a) As used in this section, the following terms shall have the following meanings: (1) CHILD. A person who is under nine years of age. (2) INCAPACITATED PERSON. As defined in Section 26-2A-20. Section 26-23G-5 Civil damages. (a) A cause of action for civil damages against an individual who has performed a dismemberment abortion in violation of Section 26-23G-3 may be maintained by any of the following: (1) Any woman upon whom a dismemberment abortion has been performed in violation of Section 26-23G-3. (2) The father of the unborn child, if married to the woman at the time the dismemberment abortion was performed. (3) If the woman had not attained the age of 18 years at the time of the dismemberment abortion or has died as a result of the abortion, the maternal grandparents of the unborn child.
