Section 25-2-19 Variations from rules or regulations. If there shall be practical difficulties
or unnecessary hardships in carrying out a rule or regulation of the board of appeals, the
board may, after a public hearing, make a variation from such requirements if the spirit of
the rule and laws shall be observed. Any person affected by such rules, or his agent or attorney,
may petition the board for such variations, stating the ground therefor. The board shall fix
a date for hearing on such petition and give reasonable notice thereof to the petitioner.
A properly indexed record of all variations made shall be kept by the clerk of the board of
appeals in the office of the Department of Labor and shall be open to public inspection. (Acts

Section 45-49-91.18 Appeals to Mobile County Commission. (a) Appeals to the Mobile County Commission
may be taken by any aggrieved person. The appeal shall be taken as provided by the rules of
the board and within the time period prescribed by its rules, by filing notice of appeal specifying
the grounds thereof with the board from whom the appeal is taken and with the Mobile County
Commission. The board shall transmit to the Mobile County Commission with the notice of appeal
all papers constituting the record upon which the action appealed from was taken. An appeal
shall stay all proceedings in furtherance of the action appealed from, unless the board certifies
to the Mobile County Commission, after receiving notice of the appeal, that by reason of facts

Section 11-19-19 County board of adjustment. In availing itself of the powers conferred by
this chapter, the county commission shall provide for the appointment of a board of adjustment
and may provide that the said board of adjustment shall, in appropriate cases and subject

fines. (a) The board may levy and collect administrative fines not to exceed five thousand
