Section 38-12-32 Definitions. As used in this article, the following terms shall have the following meanings: (1) CAREGIVER. An individual 21 years of age or older, other than a child's parent, legal guardian, or legal custodian who is an approved foster parent, who is a relative of the child, and who has been providing care and support for the child while the child has been residing in the caregiver's home for at least the last six consecutive months while in the legal custody of the Department of Human Resources, a designated official for a child-placing agency, or a successor guardian. (2) CHILD. An individual under 18 years of age who is in foster care with the caregiver and over whom a court has exercised continuing jurisdiction. (3) COURT. The juvenile court. (4) DEPARTMENT. Section 38-6-5 Persons eligible for medical assistance. Medical assistance for the aged shall be payable under this chapter on behalf of any needy person who has attained the age of 65 years and who: (1) Has made application therefor in the manner prescribed by the State Department of Human Resources; (2) Has been certified by the appropriate medical profession to be in need of medical assistance under this chapter; (3) Has not sufficient income and resources (including insurance, workers' compensation, etc.) to meet the cost of necessary medical services; (4) Is a resident of the state; (5) Has not directly or indirectly disposed of or deprived himself of any property for the purpose of qualifying for the benefits of this chapter; (6) Is not receiving an old age pension. (a) Upon application of the county commission or like governing body of the several counties of the state, the Department of Transportation shall participate in the salary of the engineer trainee in the county in an amount equal to 50 percent of the annual salary of the engineer trainee.
