Section 22-13A-4 Establishment and promotion of program; duties of officer; strategies for raising public awareness and educating consumers and professionals. (a) The State Department of Health, hereinafter referred to as "the department," shall establish, promote, and maintain an osteoporosis prevention and treatment education program in order to raise public awareness, educate consumers, educate and train health professionals, teachers, and human service providers, and for other purposes. (b) For purposes of administering this chapter, the State Health Officer shall do all of the following: (1) Provide sufficient staff to implement the Osteoporosis Prevention and Treatment Education Program. (2) Provide appropriate training for staff of the Osteoporosis Prevention and Treatment Education Program. (3) Identify the appropriate entities to carry out the program. The Medical Licensure Commission shall have the power and duty to suspend, revoke, or restrict any license to practice medicine or osteopathy in the State of Alabama or place on probation or fine any licensee whenever the licensee shall be found guilty on the basis of substantial evidence of any of the following acts or offenses: (1) Fraud in applying for or procuring a certificate of qualification to practice medicine or osteopathy or a license to practice medicine or osteopathy in the State of Alabama. A tanning facility shall perform each of the following: (1) Have an operator present during operating hours who is sufficiently knowledgeable in the correct operation of the tanning devices to inform and assist each customer in the proper use of the devices.
