Section 22-30E-7 Criteria for applicant participation in voluntary cleanup program. (a) To
qualify for participation in the voluntary cleanup program as provided in this chapter, an
applicant shall not, unless granted a variance under subsection (b), be in violation of any
order, judgment, statute, rule, or regulation subject to the enforcement authority of the
department with respect to the qualifying property. (b) The department may promulgate rules
and regulations to implement this section, including rules granting a variance from the eligibility

Section 22-30E-4 Authority of the department to establish rules and regulations. (a) The department,
acting through the commission, may adopt, promulgate, modify, amend, and repeal rules and
regulations to implement and enforce this chapter as necessary to provide for the voluntary
assessment, cleanup, reuse, and redevelopment of qualifying properties. All rules and regulations
established pursuant to this chapter shall comply with applicable provisions of the Alabama

Section 22-30E-6 Criteria for property qualification for voluntary cleanup program. (a) In
order to be considered a qualifying property for participation in the voluntary cleanup program
established pursuant to this chapter, a property shall, unless granted a variance under subsection
(b), meet the following criteria: (1) The property must not be listed on the federal National
Priorities List pursuant to the federal Comprehensive Environmental Response, Compensation,
and Liability Act, 42 U.S.C. §9601, et seq. (2) The property must not be currently undergoing
response activities required by an order of either the department, or the regional administrator
of the federal Environmental Protection Agency issued pursuant to the provisions of the federal

Section 22-30F-3 Definitions. The following words and phrases, whenever used in this chapter,
shall have the following respective meanings unless the context clearly indicates otherwise:

Section 22-30E-5 Additional powers and duties of department. (a) In addition to the powers
and duties specified in this chapter and in Sections 22-22A-1 to 22-22A-16, inclusive, the

Section 34-27A-19 Continuing education requirements; regulations; requirement for reinstatement.
(a) As a prerequisite to renewal of a license to appraise real estate, the licensed real estate
appraiser, licensed for any classification under this article, shall present evidence satisfactory
to the board of having met the continuing education requirements of this article. (b) The
board shall set, by administrative rule, the continuing education requirements for renewal
of licenses for all classifications of real estate appraisers as required by or when necessary
to fully comply with the provisions of the Financial Institutions Reform, Recovery and Enforcement
