Section 45-4-130 Appointment; powers and duties; bond. (a) The Bibb County Commission, or any
succeeding county governing body performing the functions of the county governing body in
the county, shall employ a county engineer, who shall be a thoroughly qualified and competent
civil engineer, possessing all of the qualifications as specified for county engineers under
the general laws of the State of Alabama. The engineer shall devote his or her entire time
and attention to the maintenance and construction of the Bibb County public roads, highways,
bridges, and ferries. (b) The county engineer shall be appointed by the county commission
from a nomination made by the State Director of Transportation. If the nomination is not acceptable
to the county commission, the State Director of Transportation shall be requested to make

Section 9-16-2 Definitions. Unless clearly indicated otherwise by the context, as used in this
article, the following terms have the following meanings: (1) AFFECTED LAND. The area of land
from which overburden has been removed or upon which overburden has been deposited after October

Section 24-5-14 Penalties; disposition of funds. (a) Whoever violates this article or any regulation
or order issued under this article shall be liable for a civil penalty of not to exceed one
thousand dollars ($1,000) for each such violation. Each violation of any section of this article
or regulation or order shall constitute a separate violation with respect to each manufactured
home or with respect to each failure or refusal to allow or perform an act required thereby,
except that the maximum civil penalty may not exceed one million dollars ($1,000,000) for
any related series of violations occurring within one year from the date of the first violation.
Before the commission shall impose a civil penalty it shall first advise the violator of its
intention to do so and hold a hearing on the violation no sooner than two weeks after notification
