Section 45-49-252.14 Certain acts and practices prohibited. (a) It shall be unlawful to dispose of solid waste except by sanitary landfill, incineration, recycling process, or other method approved by the director, consistent with applicable state law, operated by the county or permitted and possessing certificates of need as required herein. (b) It shall be unlawful to allow an unauthorized accumulation of rubbish, yard trash, garbage, and putrescible waste on any residential or commercial premises not engaged in a salvaging operation. (c) It shall be unlawful for any person other than the owner or collector, or his or her agent, or employees to collect refuse or to interfere in any manner with any such receptacles from the place where the same are placed by the owner or person lawfully in control thereof, or to remove the contents of such receptacles. Section 22-40A-3 Definitions. The following terms shall have the following meanings unless the context clearly indicates otherwise: (1) APPROVED. Authorized, certified, permitted by, or meets standards of a regulatory authority. (2) AUTHORIZED DISPOSAL. Section 45-49-252.09 Disposal of waste. (a) All solid waste in Mobile County shall be disposed of in accordance with this code and this part. No solid waste shall be disposed of except in approved disposal facilities operated by the county or by persons possessing valid permits and certificates of need issued according to this part. However, solid waste material may be used for construction site fill with the approval of the Mobile County Building Inspector. The approval shall be in writing. (b) Any producer of hazardous or infectious waste shall possess a permit for handling or managing solid waste issued in accordance with Section 45-49-252.05. The Director of the Alabama Department of Environmental Management, with the advice and consultation of the Solid Waste Management Advisory Committee, is directed to prepare a State Solid Waste Management Plan. (a) Each county and any municipality as described below shall submit to the department, within one and one-half years of May 16, 1989, a plan for the management of solid waste generated within its boundaries. A county's plan shall include the municipal jurisdictions within its boundaries except that any municipality may choose to submit its own solid waste management plan intended for implementation within its city limits and thereby be excluded from its county plan. (a) In addition to any regulatory bodies, the governing body of a county or municipality has a responsibility for and the authority to assure the proper management of solid wastes generated within its jurisdiction in accord with its solid waste management plan. A governing body may assign territories and approve or disapprove disposal sites in its jurisdiction in accord with the plan approved for its jurisdiction.
