Section 45-29-90.19 Freedom of authority from state supervision and control. This article
is intended to aid the State of Alabama in the execution of its duties by providing an appropriate
and independent political subdivision of the state with full and adequate powers to fulfill
the functions herein authorized. No proceeding, notice, or approval shall be required for
the incorporation of the authority or the amendment of its certificate of incorporation, the
acquisition of any property or facilities, or the issuance of any bonds, mortgage and deed

Section 45-43-170.03 Solid waste disposal - Definitions. As used in this article, the
following words shall have the following meanings respectively ascribed to them unless the
context clearly indicates otherwise: (1) BURNING. No garbage or rubbish containing garbage
or other putrescible materials or hazardous wastes shall be burned except in approved incinerators
meeting the regulations of the Alabama Department of Environmental Management requirements

Section 9-1-6 Declaration of public policy and legislative intent; measure of damages
for the unauthorized removal of coal; retroactive application of section. (a) The objective
of this section is to specify the measure of damages for the unauthorized removal of
coal in Alabama. It is declared that the extraction of coal provides a major present and future
source of energy and is an essential and necessary activity which contributes to the economic
and material well-being of the state. In the absence of a reasonable measure of damages as
specified in this section, confusion could result in the coal industry causing financial
distress and unemployment, and may cause the abandonment and prevent the use of many coal
