Section 40-23-4 Exemptions. (a) There are exempted from the provisions of this division and
from the computation of the amount of the tax levied, assessed, or payable under this division
the following: (1) The gross proceeds of the sales of lubricating oil and gasoline as defined
in Sections 40-17-30 and 40-17-170 and the gross proceeds from those sales of lubricating
oil destined for out-of-state use which are transacted in a manner whereby an out-of-state
purchaser takes delivery of such oil at a distributor's plant within this state and transports
it out-of-state, which are otherwise taxed. (2) The gross proceeds of the sale, or sales,
of fertilizer when used for agricultural purposes. The word "fertilizer" shall not
be construed to include cottonseed meal, when not in combination with other materials. (3)
The gross proceeds of the sale, or sales, of seeds for planting purposes and baby chicks and

Section 40-27-1 Compact adopted; terms. The following Multistate Tax Compact is hereby approved,
adopted and enacted into law by the State of Alabama: Multistate Tax Compact Article I. Purposes.
The purposes of this compact are to: 1. Facilitate proper determination of state and local
tax liability of multistate taxpayers, including the equitable apportionment of tax bases

Section 25-8-59 Penalties; notice of violation and opportunity to show cause; hearing. (a)
Any employer who violates this chapter, or who fails or refuses to obey within a reasonable
time any lawful order or direction given by the state officials charged with the enforcement
of this chapter, and any parent, guardian, or custodian who suffers or permits a person under
his or her care or control who is under 19 years of age to work in violation of this chapter,
shall be subject to civil penalties in addition to other penalties provided in this chapter.

Section 12-21-302 Request for hearing to show cause why subpoena should be issued for cross-examination.
(a) The party against whom the certificate is offered may request, not later than 30 days
prior to the commencement of the hearing or trial, a hearing to show cause why a subpoena
should be issued for cross-examination of the person who performed the examination or analysis.
(b) The request shall be in writing and shall contain a certification that the requesting
party intends in good faith to conduct the cross-examination. The request shall also include
a statement of the basis upon which the requesting party intends to challenge the findings

Section 27-32-36 Assessments - Order to pay - Judgment. (a) Upon the return day of the order
to show cause provided for in Section 27-32-34, if the member or subscriber does not appear
and serve duly verified objections upon the commissioner, the court shall make an order adjudging
that such member or subscriber is liable for the amount of the assessment against him, together
