Section 45-47-250.02 Marion County Public Water Authority - Incorporation. (a) Within 45 days after May 4, 1989, three applicants shall be appointed to proceed to incorporate the Marion County Public Water Authority by filing for record in the office of the judge of probate of the county a certificate of incorporation which shall comply in form and substance with the requirements of this section and which shall be in the form and executed in the manner provided in this section. The applicants shall be appointed as follows: One applicant shall be appointed by the state senator who represents the senatorial district in which Marion County is located; one applicant shall be appointed by the members of the House of Representatives representing Marion County; and one applicant shall be appointed by the Marion County Commission. Section 9-16-81 Licenses required; application; qualifications; fees. (a) All surface coal mining operations shall be subject to this article, except as excluded in Section 9-16-99. (b) No person shall engage in or carry out on lands within the state any surface coal mining operations unless such person is a citizen of the United States or, if not a citizen of the United States, a person who is legally present in the United States with appropriate documentation from the federal government and has first obtained a license in accordance with this section. (a) No person shall manufacture or sell a commercial feed in this state, unless he or she has filed with the commissioner on forms provided by the commissioner, his or her name, place of business, and location of each manufacturing facility from which feed may be shipped within or into this state. (b) The person shall apply for and obtain from the commissioner a license authorizing the sale and distribution of commercial feed.
