Section 2-27-5 Exceptions to applicability of article. (a) The provisions and requirements
of this article shall not apply to: (1) Any carrier while lawfully engaged in transporting
a pesticide within this state if such carrier shall, upon request, permit the commissioner
or his designated agent to copy all records showing the transactions in and movement of the
articles; (2) Any bona fide public or private research institution or agency; or (3) The manufacturer
or shipper of a pesticide for bona fide experimental use only, provided the manufacturer or
shipper obtains a permit from the commissioner for such use which will be conducted under
supervision of a qualified person and other conditions and requirements prescribed by rules
and regulations adopted for this purpose, which shall require the quantity of pesticides to
be used, location of use, crops or other objects of use, results of findings and other information

distribute, sell, or offer for sale any rigid plastic container, including a plastic beverage
container, labeled "degradable," "biodegradable," "compostable,"

Section 2-22-7 Labeling of commercial fertilizers. (a) Any commercial fertilizer sold in this
state for use therein or sold for importation into this state for use therein in containers
shall have printed on or affixed to the container a label setting forth in clearly legible
and conspicuous form the following information: (1) The net weight; (2) The brand and grade;
(3) The guaranteed analysis; (4) The materials from which the plant nutrients are derived
with the percentage of each as may be required by regulations of the board; and (5) The name
and principal address of the manufacturer or other person responsible for placing it on the

Section 45-31-241.02 Levy of tax for jail construction and maintenance; excess funds for road
and bridge projects. (a) This section shall only apply to Geneva County. (b) As used in this
section, state sales tax means the tax imposed by Article 1 of Chapter 23 of Title 40 and
state use tax means the tax imposed by Article 2 of Chapter 23 of Title 40. (c) (1) In addition
to all other taxes authorized by law, the Geneva County Commission may levy up to a one percent
sales tax and up to a one percent use tax. (2) The proceeds of the tax shall be used for the
construction, maintenance, and operation of a jail with any excess proceeds to be used for
road and bridge projects. (3) The proceeds of all sales which are presently exempt under the

Section 9-10B-20 Submission of declaration of beneficial use; requirements and limitations;
certificate of use. (a) A declaration of beneficial use shall be submitted within 90 days
of the promulgation of rules and regulations governing such declarations by each public water
system that regularly serves, individually or in combination with other such systems, more
than 10,000 households and by each person who diverts, withdraws, or consumes more than 100,000

Section 2-27-16 Penalty for violation of article; injunctions. (a) Any person who shall violate
any of the provisions of this article declared to be unlawful or who shall fail or refuse
