Section 22-30-12 Permit program. (a) The department, acting through the commission, is authorized to promulgate a permit program for hazardous waste management practices and, acting through the commission, to promulgate criteria for issuing permits and rules identifying procedures for obtaining permits. (b) Except as provided by this subsection or subsections (i) and (j) of this section, no person shall engage in the transportation, treatment, storage or disposal of hazardous waste without having applied for and obtained a permit from the department issued under authority of this section. Section 22-30-15 Regulations as to transporters. Subject to Section 22-30-21, the department, acting through the commission, is authorized to promulgate regulations establishing such standards, applicable to transporters of hazardous waste identified or listed under this chapter, as may be necessary to protect human health or the environment. (a) In addition to any other provision of law or any rule or regulation by the state or federal government or local government in Limestone County, and specifically Chapter 27, Title 22, as amended, relating to the regulation, operation, or location of any privately-owned or controlled regional landfill for solid waste, the Limestone County Commission shall provide for a referendum on the question of the location, acceptance, or operation of such privately owned or controlled regional landfill for solid waste after the public hearing thereon.
