Section 27-17A-32 Rights of seller; powers and duties of trustee. (a) If amounts paid by the
purchaser under a preneed contract for funeral merchandise have previously been deposited
in trust, the seller may withdraw the principal amount and trust appreciation attributable
to the delivered item at such time as the funeral merchandise is delivered or installed or,
if comprised of materials designed to withstand prolonged, protected storage without deterioration,
the merchandise is placed in storage with a responsible third party bonded and insured for
the wholesale value thereof and evidenced by a receipt specifically identifying the item,
the specific preneed contract, the location of the item, and the identity and address of the
bonding and insuring parties. For purposes of this subsection only, caskets and alternative
containers may not be held in storage by the seller or a third party storage facility prior

Section 34-40-11 Hearing upon application or filing of charges; procedure; appeal. (a) Any
person whose application for a license is denied is entitled to a hearing before the board
if the person submits a written request to the board. Proceedings for revocation or suspension
of a license shall be commenced by filing charges with the board in writing and under oath.
The charges may be made by any person or persons. The secretary shall fix a time and place
for a hearing and shall cause a written copy of the charges or reason for denial of a license,
together with a notice of the time and place fixed for hearing to be served on the applicant
requesting the hearing or the licensee against whom the charges have been filed at least 20

Section 9-16-79 Hearings and appeals procedure. Procedures for hearings and appeals under this
article shall be made as herein provided and in accordance with such general rules and regulations

Section 9-16-89 Performance bonds and bond releases. (a) After a surface coal mining and reclamation
permit application has been approved but before such a permit is issued, the applicant shall
file with the regulatory authority, on a form prescribed and furnished by the regulatory authority,
a bond for performance payable to the state and conditioned upon faithful performance of all
the requirements of this article and the permit. The bond shall cover all lands disturbed

Section 11-65-25 Review of applications for permits. A commission shall promptly consider any
application for a permit submitted to it and shall issue or deny such permit based on the
information in the application and all other information before it, including the results
