Section 40-2A-7 Uniform revenue procedures. (a) Maintenance of records; audit and subpoena
authority; authority to issue regulations. (1) In addition to all other recordkeeping requirements
otherwise set out in this title, taxpayers shall keep and maintain an accurate and complete
set of records, books, and other information sufficient to allow the department to determine
the correct amount of value or correct amount of any tax, license, permit, or fee administered
by the department, or other records or information as may be necessary for the proper administration

Section 35-6A-6 Determination of value of property; appraisal; notice and hearing. (a) Except
as otherwise provided in subsection (b) and subsection (c), if the court determines that the
property that is the subject of a partition action is heirs property, the court shall determine
the fair market value of the property by ordering an appraisal pursuant to subsection (d).
(b) If all cotenants have agreed to the value of the property or to another method of valuation,
the court shall adopt that value or the value produced by the agreed method of valuation.
(c) If the court determines that the evidentiary value of an appraisal is outweighed by the
cost of the appraisal, the court, after an evidentiary hearing, shall determine the fair market

Section 18-1A-196 Basis for opinion as to value. As a basis for an opinion as to value, a valuation
witness qualified under subsection (a) of Section 18-1A-192 may consider, inter alia: (1)

Section 35-6A-2 Definitions. For the purposes of this chapter, the following terms shall have
the following meanings: (1) ASCENDANT. An individual who precedes another individual in lineage,

Section 40-29-34 Authority to release levy and return property. (a) Release of levy. It shall
be lawful for the commissioner or his delegate to release the levy, and any liens, upon all
or part of the property or rights to property levied upon, where the commissioner or his delegate,

Section 19-3A-106 Conversion to unitrust. (a) Unless expressly prohibited by the governing
instrument, a trustee may convert a trust into a unitrust as described in this section if

and equalizing any class or classes of property has been completed by order of the Department
