Section 17-13-2 Applicability of chapter; applicability of general election laws to primary
elections. All primary elections held by any political party in this state for the nomination
of any state, national, district, circuit, county, or municipal officer shall be held and
conducted under the provisions of this chapter and, except as herein modified, shall be held
and conducted in the same manner and form, under the same requirements and subject to the
same forfeitures, penalties, and punishments as are now or shall hereafter be provided by
law for the holding of regular state elections, but nothing herein contained shall make it

Section 11-46-9 Election commission in Class 1 municipality. In any Class 1 municipality, the
mayor, the city attorney, and the president of the city council shall constitute an election

Section 17-11-15 Performance of duties of clerk in municipal elections held separate from primary
or general election. In any municipal election that is held at a time different from a primary
or general election, the duties with reference to the handling of absentee ballots which are
required of the circuit clerk shall be performed by the town clerk, city clerk, or other officer
performing the duties of the clerk. If such clerk or other officer is also a candidate in
