Section 16-40-8 Cardiopulmonary resuscitation. (a) Effective upon the effective dates of this section, all students enrolled in health classes in the tenth grade in the public schools of Alabama shall receive instruction in the techniques of cardiopulmonary resuscitation, hereinafter referred to as "CPR." (b) The State Department of Education shall administer the CPR instruction program and be responsible for the training of personnel, and shall provide proper CPR training for teacher personnel from September 1, 1983, to be completed by September 1, 1984. (1) CPR training programs for instructors shall continue after this period of time to provide for refresher courses and updating of new techniques and information. (a) No private postsecondary institution, except those enumerated in Section 16-46-3, shall operate within this state unless the private postsecondary institution first secures a license from the Department of Postsecondary Education, regardless of whether the private postsecondary institution enrolls Alabama students or has a physical presence within the State of Alabama. In Madison County, the parent or guardian of a public school student who resides in an area that has been annexed to a municipality since January 1, 1960, and who is currently being denied public school transportation service by that municipality's school system and who resides five miles or more from the nearest municipal school of the appropriate grade level for the student, shall have the option of enrolling his or her student so affected in the county school system.
