Section 40-23-4 Exemptions. (a) There are exempted from the provisions of this division
and from the computation of the amount of the tax levied, assessed, or payable under this
division the following: (1) The gross proceeds of the sales of lubricating oil and gasoline
as defined in Sections 40-17-30 and 40-17-170 and the gross proceeds from those sales of lubricating
oil destined for out-of-state use which are transacted in a manner whereby an out-of-state
purchaser takes delivery of such oil at a distributor's plant within this state and transports
it out-of-state, which are otherwise taxed. (2) The gross proceeds of the sale, or sales,
of fertilizer when used for agricultural purposes. The word "fertilizer" shall not
be construed to include cottonseed meal, when not in combination with other materials. (3)
The gross proceeds of the sale, or sales, of seeds for planting purposes and baby chicks and

Section 11-65-36 Application of net commission revenues. All commission horse wagering
fees, commission greyhound wagering fees, and other fees, commissions, and moneys, including
fines and forfeitures, to which a commission shall be entitled under the provisions of this
chapter shall be paid to the treasurer of such commission and shall be deposited by said treasurer

Section 25-4-10 Employment. (a) Subject to other provisions of this chapter, "employment"
means: (1) Any service performed prior to January 1, 1978, which was employment as defined

Section 16-60-197 Additional vocational trade schools authorized. The State Board of
Education is hereby authorized, empowered and directed to establish and provide for the construction
of three new vocational trade schools in this state in addition to the trade schools heretofore
provided by law, to be located at such places as will make such schools conveniently accessible

Section 16-4-8 Review of action of county and city boards. The State Superintendent
of Education, under rules and regulations promulgated by the State Board of Education, shall
have the authority to review actions and orders of county and city boards of education and
of county superintendents of education and city superintendents of schools in matters relating

Section 16-8-18 Joint maintenance of schools - Between counties; attendance by pupils
near county lines. The county boards of education of two or more counties shall have power
to provide jointly for the maintenance of schools in or near the dividing line of such counties
on the basis of the enrollment in such school from the counties represented. Each pupil who
lives within five miles of a county boundary line shall attend the school nearest to his residence.
The administration and supervision of such school shall be placed under one of the county
boards of education of said counties by agreement between the county boards of education,
and if no agreement as to administration and supervision is made, it shall be under the board

Section 16-8-19 Joint maintenance of schools - State-line schools. When a county board
of education desires to provide for the joint maintenance of a public school by a county in
this state and an adjoining county in another state, said board shall ascertain what agreement
with the authority having power to bind the county in the other state may be secured for such
joint maintenance, and if the county board deems the conditions of the agreement mutually
advantageous, it shall certify the same, together with all the facts, to the State Superintendent
