Section 16-13A-9 Reserve funds. (a) A local board of education shall develop a plan to establish and maintain a minimum reserve fund equal to one month's operating expenses. Also, a local board of education shall develop a plan to replenish its reserve fund after any withdrawal is made pursuant to subsection (b). (b) Local boards of education are authorized to expend such reserve funds if either of the following occur: (1) The Governor declares proration in the Education Trust Fund. (2) Total state funds appropriated by the Legislature to the local boards of education are less than the same appropriation for the preceding fiscal year. Effective October 1, 1997, all the assets of the retirement system shall be credited according to the purpose for which they are held among three funds, namely: The Annuity Savings Fund, the Pension Accumulation Fund, and the Expense Fund. Section 16-13-234 Allocation of funds. (a) In making apportionment of the Public School Fund held by the state, to the local boards of education, the State Superintendent of Education shall first set apart and distribute to the schools of each township the amount due from the state thereto as interest on its sixteenth section fund, or other trust fund held by the state. (b) It is the intent of the Legislature to insure that no local board of education receive less state funds per pupil than it received in fiscal year 1994-95.
