Section 16-13-96 Sale - Generally. All warrants issued hereunder shall be sold to the
highest bidder at public sale unless sold at a better price within 30 days after failure to
receive any acceptable bid at a duly advertised public sale in accordance with this section.
A public sale shall be either on sealed bids or at auction. Bidders may be invited to name
the rate or rates of interest which the warrants are to bear or the board of education may
name a rate or rates of interest and invite bids thereon. The notice of a public sale shall
state whether the sale is to be on sealed bids or at auction and shall also state the amount
of the warrants to be sold, the maturities thereof, whether county or district tax is to be

Section 16-13-120 Authority to issue; interest rate; terms, use of proceeds, etc. In
any county in which a special license or privilege tax or excise tax may now or hereafter
be levied, or the proceeds of any ad valorem tax equivalent shall be apportioned, by local
act of the Legislature of Alabama, the county board of education of the county or the city
board of education of any city in the county, as the case may be, may sell and issue interest-bearing
warrants, the principal of and the interest on which shall be payable solely from that portion

finds that the number of students attending the several school systems located in those areas
of North Alabama that will be directly impacted by the 2005 BRAC and Subsequent BRAC Actions
will collectively increase by an estimated 9,000 students. As a result, there will be a need
for the construction of additional school facilities as well as the renovation of existing

Section 16-16-14 Use of bond proceeds for loans to local boards of education. The proceeds
derived from the sale of any bonds issued pursuant to subsection (b) of Section 3 of
Act 98-373 shall be deposited in the State Treasury and shall be carried in a separate fund
therein for the account of the authority, which shall pay therefrom the expenses of issuance
thereof. The proceeds from the sale of the bonds remaining after payment of the expenses of
issuance thereof shall be retained in such fund and, until they are paid out, shall be invested
by the State Treasurer at the direction of the authority in permitted investments which mature
