Section 10A-1-1.03 Definitions. As used in this title, unless the context otherwise requires,
the following terms mean: (1) AFFILIATE. A person who controls, is controlled by, or is under
common control with another person. An affiliate of an individual includes the spouse, or
a parent or sibling thereof, of the individual, or a child, grandchild, sibling, parent, or
spouse of any thereof, of the individual, or an individual having the same home as the individual,
or a trust or estate of which an individual specified in this sentence is a substantial beneficiary;
a trust, estate, incompetent, conservatee, protected person, or minor of which the individual
is a fiduciary; or an entity of which the individual is director, general partner, agent,

Section 15-20A-35 Youthful offender treated as juvenile or adult. For the purposes of this
chapter, a youthful offender sex offender who has not been previously adjudicated or convicted
of a sex offense and who has not yet attained the age of 18 at the time of the offense shall
be considered a juvenile sex offender. A youthful offender sex offender who has been previously
adjudicated or convicted of a sex offense as a juvenile sex offender, youthful offender sex
offender, or adult sex offender, or who has attained the age of 18 at the time of the offense
shall be treated as an adult sex offender convicted of a sex offense. A youthful offender
sex offender who is treated as a juvenile sex offender for purposes of this chapter may not
be released from the jurisdiction of the sentencing court until the youthful offender sex
offender has undergone sex offender treatment and a risk assessment as required by Section

Section 15-20A-11 Adult sex offender - Prohibited residence locations, etc. (a) No adult sex
offender shall establish a residence or maintain a residence after release or conviction within
2,000 feet of the property on which any school, childcare facility, or resident camp facility
is located unless otherwise exempted pursuant to Sections 15-20A-23 and 15-20A-24. For the
purposes of this section, a resident camp facility includes any place, area, parcel, or tract
of land which contains permanent or semi-permanent facilities for sleeping owned by a business,
church, or nonprofit organization used primarily for educational, recreational, or religious
purposes for minors and the location of the resident camp has been provided to local law enforcement.
Resident camp does not include a private residence, farm, or hunting or fishing camp. (b)

Section 12-15-306 Removing a child from the custody of a parent, legal guardian, or legal custodian.
(a) A child may be removed by a law enforcement officer from the custody of a parent, legal
guardian, or legal custodian if there are reasonable grounds to believe any of the following:
(1) The child is suffering from an illness or injury or is in imminent danger from the surroundings
of the child and that the removal of the child is necessary for the protection of the health
and safety of the child. (2) The child has no parent, legal guardian, legal custodian, or
other suitable person able to provide supervision and care for the child. (b) The person removing
