Section 45-4-83.01 Definitions. For purposes of this part, the following terms shall have the following meanings: (1) DISTRICT ATTORNEY. The elected District Attorney of the Fourth Judicial Circuit or any of his or her staff. (2) LAW ENFORCEMENT or LAW ENFORCEMENT OFFICER. Any person who is employed by an agency or department whose purpose is to protect people. This may include, but is not limited to, police personnel, sheriff personnel, Department of Human Resources personnel, Department of Public Safety personnel, parole and probation personnel, community corrections office personnel, and court referral office personnel, whether that agency or department is in the State of Alabama or located elsewhere. (3) OFFENDER. Any person charged with a crime as defined by this code which was allegedly committed in the jurisdiction of the Fourth Judicial Circuit. Section 45-45-83.46 Fees. (a) An applicant may be assessed a fee when the applicant is approved for the program. The amount of the assessment for participation in the program shall be in addition to any court costs, assessments for victims, or drug, alcohol, or anger management treatment required by law, the district attorney, or the court and shall be in addition to costs of supervision, treatment, and restitution for which the pretrial admittee may be responsible. Pretrial intervention program fees, as established by this section, may be waived or reduced due to indigency or reduced ability to pay or for just cause at the discretion of the district attorney. The determination of indigency of the offender, for the purpose of pretrial intervention admission or fee waiver or reduction shall be made by the district attorney. Section 12-19-311 Bail bond fees. (a)(1) In addition to all other charges, costs, taxes, or fees levied by law on bail bonds, additional fees as detailed in paragraph a. and paragraph b. shall be imposed on every bail bond in all courts of this state. The fee shall not be assessed in traffic cases, except for those serious traffic offenses enumerated in Title 32, Chapter 5A, Article 9. Where multiple charges arise out of the same incident, the bond fee pursuant to this section shall only be assessed on one charge.
