Section 40-2B-2 Alabama Tax Tribunal. (a) Statement of Purpose. To increase public confidence
in the fairness of the state tax system, the state shall provide an independent agency with
tax expertise to resolve disputes between the Department of Revenue and taxpayers, prior to
requiring the payment of the amounts in issue or the posting of a bond, but after the taxpayer
has had a full opportunity to attempt settlement with the Department of Revenue based, among
other things, on the hazards of litigation. By establishing an independent Alabama Tax Tribunal
within the executive branch of government, this chapter provides taxpayers with a means of
resolving controversies that insures both the appearance and the reality of due process and
fundamental fairness. The tax tribunal shall provide hearings in all tax matters, except those
specified by statute, and render decisions and orders relating thereto. A tax tribunal hearing

Section 2-27-2 Definitions. For the purposes of this article, unless otherwise indicated, the
following terms shall have the meanings respectively ascribed to them by this section: (1)
PESTICIDE. a. Any substance or mixture of substances intended for preventing, destroying,
repelling, attracting or mitigating any insects, rodents, nematodes, fungi, weeds or other
forms of plant or animal life and/or bacteria and viruses, except bacteria or viruses on or
in living man or other animals, which the commissioner shall declare to be a pest; and b.

Section 13A-12-3.2 Delivery sale to persons under legal minimum age prohibited; acceptance
of purchase order. (a) No person shall make a delivery sale of cigarettes to any individual
who is under the legal minimum age. (b) Each person accepting a purchase order for a delivery
sale shall comply with the provisions of this chapter and all other laws of this state generally
applicable to sales of cigarettes that occur within this state, including, but not limited
to, those laws imposing excise taxes, sales taxes, license and revenue-stamping requirements,

Section 13A-12-3.7 Collection and remittance of taxes; statement requirements. (a) Each person
who makes a delivery sale shall collect and remit to the department all excise taxes imposed
by this state with respect to the delivery and maintain evidence of the payment unless the
person is located outside the state and includes a statement on the outside of the shipping
package stating: "Alabama law requires the payment of state taxes on this shipment of
cigarettes. You are legally responsible for all applicable unpaid taxes on these cigarettes."
(b) A statement meets the requirements of this section if the following occur: (1) The statement
is clear and conspicuous. (2) The statement is contained in a printed box set apart from the

Section 2-22-5 Licenses for sale of commercial fertilizer. (a) Before any person sells or offers
for sale any commercial fertilizer in this state for use herein or before any person sells
such fertilizer for importation into this state for use herein where such person is required
to comply with the labeling requirements of Section 2-22-7, such person shall apply for and
obtain from the commissioner a license authorizing the sale of commercial fertilizer. The
application for a license shall be accompanied by the fee required by subsection (b) of this
section and shall be on forms furnished by the commissioner, which forms shall contain certain
