Section 33-12-5 Powers, duties and functions. The powers, duties and functions of the
agency shall be as follows: (1) GENERALLY. The agency a. Shall have perpetual succession in
its corporate name. b. May sue and be sued in its corporate name. c. May adopt, use and alter
a corporate seal, which shall be judicially noticed. d. May enter into such contracts and
cooperative agreements with the federal, state and local governments, with agencies of such
governments, with private individuals, corporations, associations, trusts and other organizations

Alabama Behavior Analyst Licensing Board Fund. (a) The Alabama Behavior Analyst Licensing
Board is established within the Department of Mental Health, Division of Developmental Disabilities.
The board shall consist of seven members, including four licensed behavior analysts, one licensed
psychologist in the state, one parent or legal guardian of a person being treated for a behavior
disorder, or a person who has received services from a licensed behavior analyst, and one

Section 34-9-18 Grounds for disciplinary action. (a) The board may invoke disciplinary
action as outlined in subsection (b) whenever it shall be established to the satisfaction
of the board, after a hearing as hereinafter provided, that any dentist or dental hygienist
has been guilty of the following: (1) Fraud, deceit, or misrepresentation in obtaining any

Section 40-17-371 Cost of collection; distribution of tax proceeds. (a) The Alabama
Department of Revenue shall retain one-quarter of one percent (0.25%) of the tax proceeds,
less any refunds, from this additional excise tax on gasoline and diesel fuel for its cost
of collection. The department may adopt rules and such forms as may be necessary for the administration

Section 45-34-83 Southeast Alabama Human Development Council. (a)(1) In Henry County,
the Southeast Alabama Human Development Council is hereby established as a nonprofit entity.
The members of the council are the juvenile judge, chair of the county commission, sheriff,
the members of the legislative delegation or their designee of Henry County, and two members
appointed at-large by the Board of Directors of the Southeast Alabama Human Development Council.
