Section 36-21-71 Disability benefits. Any member who becomes totally or permanently
disabled as a result of a heart attack or any injury received in the line of duty as a peace
officer not as a result of his misconduct and who makes proper application to the board on
a form to be supplied by the board and submits evidence satisfactory to the board of such
total or permanent disability and the circumstances giving rise to its occurrence shall be
entitled to be paid benefits. The board shall have the right to require that any applicant
for benefits under this section be examined by one or more physicians on behalf of
the board and at its expense. Failure of any such applicant to subject himself to such examination
shall be sufficient grounds for the board to deny payment of benefits under this section.
Any benefit paid under this section shall be paid for a period of not longer than 24
calendar months as follows: (1) Seventy-two dollars per calendar month if his qualified service

Section 36-27-25 Funds for assets of retirement system - Management. (a) The Board of
Control shall be the trustees of the several funds of the Employees' Retirement System created
by this article as provided in Section 36-27-24 and shall have full power to invest

Section 36-27-5 Membership - Members of Board of Pardons and Paroles; Director of Physical
Fitness Department. (a) Any person who has been regularly appointed to the state Board of
Pardons and Paroles or a former member of said board, or Director of Physical Fitness Department

Section 36-27-58.1 Purchase of credit for certain members away from work due to job-related
injury. (a) Notwithstanding any other laws, any active and contributing member of the Employees'
Retirement System of Alabama may purchase up to two years of service credit for the time he
or she was receiving benefits pursuant to the Alabama Workers' Compensation Act, commencing
with Section 25-5-1, and was absent from work due to a work related and compensable
injury; provided that the member returned to work with his or her covered employer within
one year following cessation of workers' compensation benefits. The Board of Control of the
Employees' Retirement System shall adopt rules and regulations for the administration of this
section including verification of the service that the member desires to purchase credit

Section 45-37-123.84 Service rules. Except as otherwise specifically stated herein,
the rules below shall apply in determining length of service for all purposes under the plan.
(1) In no case may more than one year of service be credited for service in one calendar year.
(2) A member shall work over one-half of a month, including all calendar days, in order to
earn one month of service. (3) Except as otherwise specifically stated herein or required
by federal law, a member shall not be allowed service credit for any period of more than one-half
