into the pretrial diversion program is in the sole discretion of the municipal court judge
upon application approved by the city prosecutor. An offender deemed by the city prosecutor
to be a threat to the safety or well-being of the community shall not be eligible for the
program. An offender charged with any of the following types of offenses without the express

violence or aggression resulting in injury to a law enforcement officer. (2) Any offense

Section 45-4-83.10 Pretrial Diversion Program Fund. The district attorney shall establish a
Pretrial Diversion Program Fund. Except for the twenty-five dollars ($25) payable to the circuit
clerk pursuant to subsection (c) of Section 45-4-83.07, fees paid by offenders pursuant to
Section 45-4-83.07 shall be placed into the Pretrial Diversion Program Fund. The district
attorney shall use the funds in the Pretrial Diversion Program fund to pay costs associated

Section 45-42-82.49 Program requirements; termination from program liability for costs and
fees. (a) Upon acceptance of an offender into the pretrial diversion program, the district
attorney and the offender shall submit the offender's written application together with the
offender's statement of facts, the district attorney's acceptance of the offender, and the
agreement between the district attorney and the offender to the court presiding over the offender's
affected case. The offender shall also enter a plea of guilty to the charge or charges involved.
