Section 11-92C-2 Definitions. For the purposes of this chapter, the following words
have the following meanings: (1) APPLICANT. A natural person who files a written application
with the governing body of any authorizing subdivision in accordance with Section 11-92C-3.
(2) AUTHORITY. Any local redevelopment authority organized pursuant to this chapter. (3) AUTHORIZING
RESOLUTION. A resolution adopted by the governing body of any authorizing subdivision in accordance
with Section 11-92C-3, which authorizes the incorporation of the authority. (4) AUTHORIZING
SUBDIVISION. Any county or municipality that has adopted an authorizing resolution. (5) BOARD.
The board of directors of an authority. (6) BONDS. Any bonds, notes, certificates, or any
other form of indebtedness representing an obligation to pay money. (7) CONTIGUOUS. Two or
more tracts of land if touching for a continuous distance of not less than 200 feet. The term

Section 40-9E-1 Definitions. For purposes of this chapter only, the following terms
shall have the following meanings: (1) BASE YEAR. The taxable year immediately before the
taxable year in which property first becomes qualified property under this chapter. (2) BASE
YEAR VALUE. The value of the property used to determine the assessment on which the property
tax on property is imposed for the base year. Base year value does not include any new property

Section 11-92C-3 Filing of application; authorization of incorporation by governing
body of an authorizing subdivision. (a) An authority may be organized pursuant to this chapter.
In order to incorporate a public corporation, any number of natural persons, not less than
three, who are duly qualified electors of the authorizing subdivision, shall first file a

Section 24-2-4 Approval of redevelopment plan by governing bodies of cities, counties,

Section 11-92C-8 Powers of authority. (a) The authority shall have the following powers,
together with all powers incidental thereto or necessary to the discharge thereof in corporate
form: (1) To have succession by its corporate name for the duration of time, which may be
in perpetuity, subject to Section 11-92C-20, specified in its certificate of incorporation.

Section 11-99-4 Creation of tax increment districts and approval of project plans. In
order to exercise its powers under this chapter, a public entity shall take the following
steps: (1) The local governing body shall hold a public hearing at which all interested parties
are afforded a reasonable opportunity to express their views on the concept of tax increment
financing, on the proposed creation of a tax increment district and its proposed boundaries,
and its benefits to the public entity. Notice of the hearing shall be published in a newspaper
of general circulation in either the county or in the city, as the case may be, in which the
proposed tax increment district is to be located with such notice to be published at least
twice in the 15-day period immediately preceding the date of the hearing. Prior to publication,

Section 40-23-4 Exemptions. (a) There are exempted from the provisions of this division
and from the computation of the amount of the tax levied, assessed, or payable under this
division the following: (1) The gross proceeds of the sales of lubricating oil and gasoline
as defined in Sections 40-17-30 and 40-17-170 and the gross proceeds from those sales of lubricating
oil destined for out-of-state use which are transacted in a manner whereby an out-of-state
purchaser takes delivery of such oil at a distributor's plant within this state and transports
it out-of-state, which are otherwise taxed. (2) The gross proceeds of the sale, or sales,

Section 22-27-3 Authority of local governing bodies as waste collections and disposal;
household exemptions; state regulatory program. (a) Generally. (1) The county commission or
municipal governing body may, and is hereby authorized to, make available to the general public
collection and disposal facilities for solid wastes in a manner acceptable to the department.
The county commission or municipal governing body may provide such collection or disposal
services by contract with private or other controlling agencies and may include house-to-house
service or the placement of regularly serviced and controlled bulk refuse receptacles within
