Section 11-50-340 Definitions. As used in this article, the following words and terms
shall have the following meanings unless the context shall indicate another meaning or intent:
(1) CITY. Any incorporated city in the State of Alabama. (2) COUNCIL. The city council, city
commission, or other board or body in which the general legislative powers of a city shall
be vested. (3) BOARD. A board of water and sewer commissioners created under the provisions
of Section 11-50-341 or, if any such board shall be abolished, the board, body, or
commission succeeding to the principal functions thereof or to which the powers given by this
article to such board shall be given by law. (4) WATER SYSTEM. Such term shall include all
plants, systems, facilities, or properties used or useful or having the present capacity for

Section 11-48-5 Adoption of ordinance or resolution describing proposed improvement,
ordering preparation of plans, specifications, etc., thereof, etc. (a) When the council of
any city or town shall determine to open, widen, extend, construct, or improve any street,
alley, avenue, sidewalk, highway, or other public place or to make any other public improvements
or undertake any work authorized by the provisions of this article, the cost of which or any

Section 45-37-140.11 Service charge; fire dues. (a) The expense of establishing and
maintaining a district shall be paid for from the proceeds of any service charge or fire dues
which shall be levied and collected in an amount sufficient to pay the expense. The service
charge or any fire dues shall be levied upon and collected from the property owners served
by the system. The service charge or fire dues shall be the personal obligation of the owner
of the property served by the system; and to secure the collection of any service charge or
fire dues there shall be a lien against the property in favor of the district. The lien may
